This Personal Data Privacy Policy (hereinafter referred to as the Privacy Policy) applies to all information that the website (hereinafter referred to as Easy Start) located at the domain name https://easy-start.eu/ (including its subdomains), may obtain about the User while using the site https://easy-start.eu/ (including its subdomains), its programs, and its products.
1. DEFINITIONS
1.1 The following terms are used in this Privacy Policy:
1.1.1. "Site Administration" (hereinafter referred to as the Administration) – authorized employees managing the Easy Start site, who organize and/or carry out the processing of personal data, and also determine the purposes of personal data processing, the composition of personal data to be processed, and the actions (operations) performed on personal data.
1.1.2. "Personal data" – any information relating to an identified or identifiable natural person (data subject).
1.1.3. "Processing of personal data" – any action (operation) or set of actions (operations) performed using automated tools or without such tools on personal data, including collection, recording, organization, accumulation, storage, updating (modification), extraction, use, transfer (distribution, provision, access), anonymization, blocking, deletion, destruction of personal data.
1.1.4. "Confidentiality of personal data" is a mandatory requirement for the Operator or any other person who has access to personal data to prevent its distribution without the consent of the data subject or other legal basis.
1.1.5. "Website Easy Start" is a collection of interconnected web pages available on the Internet at the unique address (URL): https://easy-start.eu/, including its subdomains.
1.1.6. "Subdomains" are pages or sets of pages located on third-level domains belonging to the Easy Start website, as well as other temporary pages, at the bottom of which contact details of the Administration are indicated.
1.1.7. "User of the Easy Start website" (hereinafter referred to as the User) – a person who has access to the Easy Start website via the Internet and uses the information, materials, and products posted on the Easy Start website.
1.1.8. "Cookie" is a small piece of data sent by a web server and stored on the user's computer, which the web client or browser sends back to the web server in each HTTP request when trying to open a corresponding site page.
1.1.9. "IP address" is a unique network address within a computer network through which the User gains access to Easy Start.
1.1.10. "Product" – a product that the User orders on the site and pays for via payment systems.
2. GENERAL PROVISIONS
2.1. Using the Easy Start website by the User means acceptance of this Privacy Policy and the terms of processing the User’s personal data.
2.2. In case of disagreement with the terms of the Privacy Policy, the User must stop using the Easy Start website.
2.3. This Privacy Policy applies to the Easy Start website. The Easy Start website does not control and is not responsible for third-party websites, to which the User may navigate via links available on the Easy Start website.
2.4. The Administration does not verify the accuracy of personal data provided by the User.
3. SUBJECT OF THE PRIVACY POLICY
3.1. This Privacy Policy establishes the obligations of the Administration to not disclose and to ensure the confidentiality of personal data provided by the User upon request of the Administration during registration on the Easy Start website, subscription to newsletters, or placing orders.
3.2. Personal data authorized for processing under this Privacy Policy is provided by the User by filling out forms on the Easy Start website and includes the following information:
3.2.1. surname, first name, patronymic of the User;
3.2.2. User’s contact phone number;
3.2.3. e-mail address;
3.2.4. User’s place of residence (if necessary);
3.2.5. delivery address of the Goods (if necessary);
3.2.6. photograph (if necessary).
3.3. Easy Start protects data that is automatically transmitted when visiting pages:
— IP address;
— cookie information;
— browser information;
— access time;
— referrer (address of the previous page).
3.3.1. Disabling cookies may prevent access to parts of the site requiring authorization.
3.3.2. Easy Start collects statistics about IP addresses of its visitors. This information is used to prevent, detect, and solve technical problems.
3.4. Any other personal information not specified above (visit history, browsers used, operating systems, etc.) is subject to secure storage and non-disclosure, except as provided in sections 5.2 and 5.3 of this Privacy Policy.
4. PURPOSE OF COLLECTING USER'S PERSONAL INFORMATION
4.1. The Administration may use the User’s personal data for the following purposes:
4.1.1. Identification of the registered User on the Easy Start website for further authorization, order placement, and other activities.
4.1.2. Providing the User access to personalized data on the Easy Start website.
4.1.3. Establishing communication with the User, including sending notifications, requests regarding use of the Easy Start website, service provision, and processing requests and applications from the User.
4.1.4. Determining the User’s location to ensure security and prevent fraud.
4.1.5. Confirming the accuracy and completeness of personal data provided by the User.
4.1.6. Creating an account to use parts of the Easy Start website, if the User has agreed to create an account.
4.1.7. Notifying the User by email.
4.1.8. Providing effective technical support to the User in case of problems related to use of the Easy Start website.
4.1.9. Providing the User, with their consent, special offers, pricing information, newsletters, and other information on behalf of the Easy Start website.
4.1.10. Conducting advertising activities with the User’s consent.
5. METHODS AND TERMS OF PROCESSING PERSONAL INFORMATION
5.1. Processing of the User’s personal data is carried out without time limits, in any lawful manner, including in IT systems using automated tools or without such tools.
5.2. The User agrees that the Administration has the right to transfer personal data to third parties, particularly courier services, postal organizations (including electronic), telecommunications operators, solely for the purpose of fulfilling the User’s order placed on the Easy Start website, including delivery of Goods, documentation, or e-mail messages.
5.3. The User’s personal data may be transferred to authorized state authorities of Poland only on the grounds and in the manner established by Polish law.
5.4. In case of loss or disclosure of personal data, the Administration has the right not to inform the User about such loss or disclosure.
5.5. The Administration takes necessary organizational and technical measures to protect the User’s personal information from unauthorized or accidental access, destruction, modification, blocking, copying, dissemination, and other illegal acts by third parties.
5.6. The Administration, together with the User, takes all necessary measures to prevent loss or other negative consequences caused by loss or disclosure of the User’s personal data.
6. RIGHTS AND OBLIGATIONS OF THE PARTIES
6.1. The User has the right to:
6.1.1. Make a free decision to provide personal data necessary for using the Easy Start website and give consent to their processing.
6.1.2. Update and supplement the provided personal data in case of changes.
6.1.3. The User has the right to receive information from the Administration regarding the processing of their personal data, if such right is not restricted by law. The User has the right to request the Administration to correct, block, or delete their personal data if incomplete, outdated, inaccurate, illegally obtained, or unnecessary for the purpose of processing, and to take legal actions to protect their rights.
6.2. The Administration is obliged to:
6.2.1. Use the received information solely for the purposes specified in section 4 of this Privacy Policy.
6.2.2. Keep confidential information secret, not disclose it without prior written consent of the User, and not to sell, exchange, publish, or disclose in any other way the personal data of the User, except as provided in sections 5.2 and 5.3 of this Privacy Policy.
6.2.3. Take precautions to protect the confidentiality of the User’s personal data in accordance with procedures commonly used in business transactions.
6.2.4. Block personal data related to the User from the moment the User or their legal representative or authorized body for data protection requests or contacts the Administration, for the period of verification, in case of revealing inaccurate data or illegal activities.
7. RESPONSIBILITIES OF THE PARTIES
7.1. The Administration that fails to fulfill its obligations is liable for damages suffered by the User due to unlawful use of personal data, in accordance with Polish law, except for cases specified in sections 5.2, 5.3, and 7.2 of this Privacy Policy.
7.2. In case of loss or disclosure of confidential information, the Administration is not responsible if such confidential information:
7.2.1. Became public property before its loss or disclosure.
7.2.2. Was received from a third party before it was received by the Administration.
7.2.3. Was disclosed with the User’s consent.
7.3. The User is fully responsible for complying with Polish law requirements, including advertising law, copyright and related rights protection, trademark and service mark protection, as well as for the content and form of materials.
7.4. The User acknowledges that responsibility for any information (including but not limited to data files, texts, etc.) accessed through the Easy Start website lies with the person who provided such information.
7.5. The User agrees that information provided within the Easy Start website may be intellectual property protected and owned by other Users, partners, or advertisers who place such information on the Easy Start website.
The User may not modify, lease, lend, sell, distribute, or create derivative works based on such Content (in whole or in part), unless expressly authorized in writing by the owners of such Content under separate agreement terms.
7.6. Regarding text materials (articles, publications publicly accessible on the Easy Start website), their distribution is permitted provided that a link to Easy Start is given.
7.7. The Administration is not liable to the User for any loss or damage incurred as a result of deletion, failure, or inability to save any Content and other communication data contained on or transmitted through the Easy Start website.
7.8. The Administration is not responsible for any direct or indirect damages resulting from: use or inability to use the site or individual services; unauthorized access to User communications; statements or conduct of third parties on the site.
7.9. The Administration is not responsible for information posted by the User on the Easy Start website, including but not limited to information protected by copyright without explicit consent of the copyright owner.
8. DISPUTE RESOLUTION
8.1. Before taking court action regarding disputes arising from relations between the User and the Administration, it is mandatory to submit a claim (a written or electronic proposal for voluntary dispute resolution).
8.2. The claim recipient must notify the claimant of the claim consideration results within 30 calendar days of receiving the claim, in writing or electronically.
8.3. If no agreement is reached, the dispute will be referred to the Warsaw Arbitration Court.
8.4. The current Polish legislation applies to this Privacy Policy and the relationship between the User and the Administration.
9. FINAL PROVISIONS
9.1. The Administration has the right to make changes to this Privacy Policy without the User’s consent.
9.2. The new Privacy Policy takes effect upon posting on the Easy Start website unless otherwise stated in the new version of the Privacy Policy.
